Terms of service
These Terms of Service govern your use of fluent-power.com and purchases from the FLUENTPOWER online store. FLUENTPOWER is operated by Indee International Trading Co., Limited. By using the site or placing an order, you agree to these terms and to the policies linked at checkout. If you do not agree, do not use the site or place an order.
Store use
You must use the store only for lawful purposes and provide accurate, current, and complete information. You may not interfere with the store, attempt unauthorized access, introduce malicious code, scrape the store in a manner that disrupts service, or use the site to violate another person's rights.
Products and information
We work to display product descriptions, specifications, images, availability, and prices accurately. Screen colors and product appearance can vary. Measurements and performance figures are subject to the conditions stated in the applicable product manual. We may correct errors, update information, or cancel an affected order when material information was incorrect. Nothing on the site replaces the safety, installation, operating, and maintenance instructions supplied with the product.
Orders
An order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including product availability, suspected fraud, pricing or listing errors, payment problems, address restrictions, or inability to fulfill the order lawfully. If we cancel a paid order, we will refund the amount charged to the original payment method.
Prices, payment, and taxes
Prices are shown in United States dollars unless stated otherwise. Product prices include Free Standard Shipping to eligible United States addresses. Applicable sales tax, if any, is calculated at checkout. You authorize Shopify Payments and the applicable payment providers to process the payment information you submit. We do not guarantee that every payment method will be available for every order.
Shipping and delivery
Shipping availability, processing, estimated delivery times, delays, tracking, and address restrictions are governed by our Shipping Policy. Delivery dates are estimates unless expressly stated as guaranteed. Risk of loss passes as provided by applicable law and the carrier's confirmed delivery record, subject to any rights that cannot legally be excluded.
Returns, refunds, and cancellations
Returns, refunds, and cancellation requests are governed by our Return and Refund Policy. Product warranty coverage is governed by the warranty information supplied with the applicable product and does not limit non-waivable legal rights.
Intellectual property
The site and its content, including FLUENTPOWER names, logos, text, graphics, product photography, manuals, page designs, and software, are owned by or licensed to us and are protected by applicable intellectual-property laws. You may use the site for personal shopping and product support. No other license is granted.
Third-party services
The store uses Shopify and may link to or rely on payment processors, fulfillment providers, carriers, and other third parties. Their services may be subject to separate terms and privacy practices. We are not responsible for third-party content or services outside our reasonable control, but this does not limit our responsibility for your order under applicable law.
Disclaimer
To the fullest extent permitted by law, the site is provided on an as-available basis. We do not warrant uninterrupted or error-free access. Products are covered only by the express warranty supplied with the applicable product and any warranties that cannot be excluded by law. Do not use any pump outside its rated liquid type, electrical requirements, lift, temperature, solids, submersion, or other operating limits.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, exemplary, or consequential loss arising from use of the site or a product. Any aggregate liability relating to an order will not exceed the amount paid for that order, except where applicable law does not permit that limitation. Nothing in these terms excludes liability that cannot legally be excluded.
Indemnification
To the extent permitted by law, you agree to indemnify us against third-party claims arising from your unlawful misuse of the site, violation of these terms, or infringement of another person's rights. This provision does not apply to claims caused by our own breach or misconduct.
Severability and waiver
If any provision is held unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver of that right.
Governing law
These terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-law principles, except that consumers retain any mandatory protections provided by the law applicable to them.
Changes
We may update these terms by posting a revised version with a new effective date. Changes apply prospectively and do not reduce rights attached to an order placed before the change.
